Beijing High People’s Court recently published TOP10 IPR cases for 2012, and among them is a Microsoft action for copyright infringement. Lifang partners, Mr. Xie Guanbin and Ms. Zhang Bin, represented Microsoft in the case which was publicly heard on April 26, 2012, the World Intellectual Property Day. The court eventually found the defendant to have infringed, ordered C&D and ordered the defendant to compensate Microsoft for economic losses in the amount of 2 million RMB as well as reasonable expenses.
Beijing High Court recommends the case because it relates to copyright infringement by end users of computer software and, compared with traditional copyright cases, presents more difficulties in term of evidence preparation due to the elusive nature of such infringement. In handling cases like this, Lifang lawyers make painstaking and creative efforts to applying for evidence preservation by the court and formulating effective and practical evidence preservation plan. They are detail-oriented in setting up appropriate litigation strategy, collecting evidence, cross-examining the other party’s evidence, giving strong representation before the court and negotiating for settlement, until their diligence and untiring efforts secure the final successes for the client.
