On November 4th, 2022, Lifang’s partner, Zhang Yan, was invited to attend a conference on “Responding to Overseas Trademark Infringement and Brand Protection” and deliver a lecture on “Overseas Trademark Risk Assessment and Management”. This conference was jointly organized by the China National Overseas Intellectual Property Dispute Response and Guidance Center (Shenzhen Sub-center), WIPO Technology and Innovation Support Center (TISC), China (Shenzhen) Intellectual Property Protection Center, and Shenzhen Trademark Association. Attendees are mostly senior corporate management, IP and legal in-house, and brand and marketing managers.

In his lecture, Mr. Zhang covered issues relating to the risks of trademark infringement in overseas transactions, including OEM, trade fairs, transnational e-commerce and offline sales related scenarios. He provided case-by-case analysis along civil, administrative and criminal legal procedures, and highlight the risk that a business may unknowingly commit trademark infringement and be caught in litigation. For example, product shapes, colors, placement of one’s own trademark, logos or slogans might possibly lead to infringement upon a local trademark. Even the layout of a store may constitute an infringement of a locally registered trademark. By digging deeply into several success cases, Mr. Zhang summarized major measures and steps that can help preventing or responding potential trademark infringement charges. In the Q&A session, Mr. Zhang answered questions from the audience, giving specific and practical solutions and advice to businesses. His lecture was well received by all attendees.
