2013-09-11

The patent invalidation case between Zhongwei Bus & Coach Group and Neoplan GmbH is one of the Top 10 cases of Patent Reexamination Board in 2012 and attracts extensive attention from the media. Recently, China Intellectual Property News covered the case in details with the title ‘Truth behind the big reverse of the No.1 bus infringement case’ and interview Mr. Sun Xi, partner of Lifang & Partners and one of the lead attorneys of this case. The story is on page 9 of August 21 edition and can be visited online at http://www.cipnews.com.cn/zgzscqb/html/2013-08/21/content_35814.htm?div=-1. The official website of State Intellectual Property Office of P.R.C posts the article at http://www.sipo.gov.cn/mtjj/2013/201308/t20130821_813983.html.

Previously, Beijing Evening News interviewed another leading attorney of case, Mr. Xie Guanbin, also partner of Lifang & Partners, and published a thorough review of the case in one and a half page under the column ‘famous lawyer and notable case.' The electronic version of the news story can be accessed at http://bjwb.bjd.com.cn/html/2013-04/17/node_39.htm.

As back as 2009, the patent dispute between Neoplan and Zhongwei was dubbed by the media as ‘China's No.1 bus infringement case' because a Beijing Court found for Neoplan and awarded damages of more than 20 million RMB. Zhongwei came to Lifang lawyers who made a successful petition before SIPO and caused Neoplan's patent invalidated. The previous court decision was subsequently revoked due to loss of factual basis and Zhongwei bus was found not infringing.
