Beijing No.1 Intermediate People’s Court recently made out the Administrative Judgment (2012) Yi Zhong Xing Chu Zi No. 2059 finding for Midea in the Hefei Midea Royalstar Refrigerator Co., Ltd. v. Patent Reexamination Board patent invalidation administration case. Midea previously filed an invalidation request against a design patent of Qingdao Haier Co., Ltd. and Haier Group for a kind of four door refrigerators, but SIPO’s Patent Reexamination Board made Decision No. 18082 upholding the validity of the involved patent. After a careful study of the case, Lifang lawyers believed that the Board violated the principles of direct observation as well as of overall observation and comprehensive judgment in making the above decision. Acting on behalf of Midea, Mr. Xie Guanbin and Mr. Sun Xi appealed the Board decision to the court, which supported their opinions and revoked the Board Decision No. 18082.
