Lifang Wins for Microsoft in Copyright Infringement Case

On January 18, 2012, Beijing No.1 Intermediate People’s Court issued judgments on two cases where Lifang lawyers, Mr. Xie Guanbin and Ms. Zhang Bin, represented Microsoft in suing Beijing Newsmy Ideal Digital Technology Co. Ltd. for computer software copyright infringement. The Court has found in both cases that Newsmy infringed upon Microsoft’s copyright by its illegitimate use of Microsoft Windows and Microsoft Office series software, ordered the defendant to cease infringement and to pay Microsoft more than 410 thousand yuan as compensation for economic losses and litigation costs.

These are the first cases where court judgments were made on cases filed by Microsoft in Beijing against end users of pirated software. The Court has found the defendant to have infringed and ordered it to pay Microsoft damages as well as reasonable costs, in the spirit of protecting the lawful rights and interests of the claimant. The Court has capably handled the cases. It adopted the previous administrative enforcement files as evidence, and made a comprehensive judgment taking into account the nature, circumstances and the presence of intentional faults in determining the damages, to best protect the rights and interests of the claimant.
