Having worked in the legal profession for nearly 30 years, Mr. Cai is an experienced lawyer, who has handled both transactional and dispute resolution matters. He is well placed to serve the legal needs of clients involved in the banking and finance sectors.
For transactional work, Mr. Cai has participated in multiple investment, finance, M&A, and non-performing asset disposal projects, in which he served China Citic Bank, China Minsheng Bank, China Development Bank, Industrial Bank, and some well-known insurance and securities firms.
He is the chairman of Beijing New Hanshang Investment Management Co., and Central-South Elites Management Co. So far, as chairman of the aforesaid, he has participated in over 50 projects covering investments, M&As, and securities, and he has participated in over 100 other projects in other areas. Mr. Cai has dealt with investments that collectively amount to over RMB 1 billion. In a word, he has extensive experience in fund investment and legal practice.
For dispute resolution work, Mr. Cai has handled many influential litigation and arbitration cases since 1991. In 2019, he led a team to handle the debt crisis of a company listed on the main board of the Shanghai Stock Exchange, and represented an asset management company in a dispute worth at least RMB 90 million involving a Value Adjustment Mechanism. In 2017, he represented China Minsheng Bank in an infringement dispute, which involved 70 million RMB. In 2015, he successfully represented China Unicom in a contract dispute retrial, had the judgment amended, and procured the successful execution of said judgment. In 2014, he represented China Coal Energy Company Limited against Tangshan International Trade & Investment Company in a port operation dispute worth in excess of RMB 60 million. In 2013, he represented BOC Fullerton Community Bank against a micro-loan company in a trust management issue involving over RMB 40 million. In 2012, he represented China Minsheng Bank against Shide Group in a loan contract dispute involving RMB 680 million. In 2011, he represented China CMB Ltd., against a Hong Kong public company in a coal-bed methane purchase and distribution contract dispute involving RMB 600 million. In 2010, he represented Hubei Radio and Television Group against an advertising agency in a retrial before the Supreme People’s Court relating to contract disputes.
Earlier in his career, he represented MMIM Technologies in the MMIM Technologies Ltd. v. Tencent, Inc., unfair competition case - named one of the “Top 10 IP Cases of 2007” by the Beijing High People’s Court. Also in 2007, he represented Hubei Provincial Seed Group Co., Ltd., against Origin Agritech Inc., in a tort case for malicious litigation which was China’s first such case. In 2006, he represented the Beijing Universities Real Estate Development Corporation (BURED Corp.) in a fund management dispute involving RMB 130 million. In 2005, he represented Angel Yeast Co., Ltd., in the Angel Yeast v. Youyuan Asset Management Ltd., and Haitong Securities fund management case involving RMB 70 million. In 2003, he assisted Citibank Group to bid for the Wuhan Non-performing Assets Package of China Huarong Asset Management Corporation.
